037 Endoso en Propiedad

What is it?​

  • The endorsement in property is the one by which the ownership of the bill of exchange is transmitted or transferred from the issuer, biller, or legitimate holder (endorser) to a third party (endorsee).
  • The endorser transmits in a limited manner all the rights of the title.
  • The endorsee becomes the owner of the document as movable property.
  • Only the signature of the endorser is required (blank endorsement) or adding to the signature the name of the person to whom it is endorsed (full endorsement).
  • The event is perfected with the delivery of the title
    • With responsibility: the legitimate holder has exchange action against the endorser.
    • Without responsibility: the legitimate holder does not have exchange action against the endorser.
  • The endorsement can be made in blank or complete, for which the calculation of the CUDE changes, which must be reported in numeral 12 (@schemeName).
  • In case there is more than one endorser in the senderparty block, it must be ensured that the sending of this event of endorsement in property is issued by a Mandatario, and additionally, it must be validated that it complies with the (Acceptance Criterion – Transmission of the Event by the Mandatario) for each of the endorsers.

Who is responsible for generating the electronic document?​

  • The issuer, Biller, or its Legitimate Holder (Endorser) is responsible.

Who is responsible for receiving the electronic document?​

  • The Endorsee is responsible.
Restrictions
  • The termination of the mandate restricts the generation of this event by the attorney.
  • The event “Inscripción en el RADIAN de la factura electrónica de venta como título valor que circula en el territorio nacional” is necessary for the generation of this event.
  • The “Endoso en procuración” restricts the generation of this event.
  • The “Endoso en garantía” restricts the generation of this event.
  • The “Limitation of circulation” restricts the generation of this event.
  • The event “Endoso con efectos de cesión ordinaria” restricts the generation of this event.
  • The event “Protesto” restricts the generation of this event.
  • The event “Transferencia de los derechos económicos” restricts the generation of this event.
  • The event “Pago total de la factura electrónica de venta” (452) restricts the generation of this event.
  • Merely indicating the name of the endorsee is not enough, as the perfection of the endorsement requires the delivery of the Electronic Sales Invoice considered as a Bill of Exchange.
